ADDING FAMILY MEMBERS TO YOUR SUBCLASS 482 VISA

Introduction

If you have been granted a Subclass 482 Visa, and you did  not include your immediate family members at the time you lodged the visa, they may be added after your visa has been granted.  Your family may be outside Australia or in Australia when a subsequent application is made.

The only family members who can be added are your spouse and dependent children (including step children) under 23.  It is not possible to add parents or other non-relatives to your 482 visa.

The applicable visa application charge will depend upon the occupation list that your own visa was granted under.

What are the eligibility requirements for the visa applicant?

 

Be a member of the family unit  (Spouse, or dependent child/stepchild under 23) of a person who currently holds a Subclass 482 visa for Australia, and who is working for their employer sponsor.  

In the case of step children under 18; the child’s other parent needs to give written consent to the child being granted the visa, unless there is a court order for sole custody in place.

Children between 18 and 23 must be dependent on the family head.   They must show that they have been in full time education since leaving school, and continue to be dependent on the family head for the basic necessities of food, clothing and shelter.    If a child has become independent for a time (worked full time, or had a break in education, or a gap year), it can be difficult to prove that they meet these requirements.

The employer sponsor must give approval in writing for the family to be added to the visa.

What will this visa provide?

The subsequent applicants will be granted a Subclass 482 Visa which has the same expiry date as the primary visa holder’s 482 visa.    

If a dependent child is under 23; they will only be granted a 482 visa up to the date before their 23rd birthday, unless the primary applicant’s visa expiry date is before then.

The subsequent applicants will have the chance to apply for permanent residency as dependents on the primary applicant, if they choose to apply for an Employer Sponsored permanent residency visa, as long as they are holding the same Subclass 482 visa before the permanent visa is lodged. Children do not have to remain dependent on the family head, to access the permanent residency pathway.  This allows a child who has graduated since obtaining the 482 visa, to preserve their right to permanent residency while still holding the Subclass 482 visa.
