PERMANENT RESIDENCE (SKILLED REGIONAL) VISA

SUBCLASS 191

The Subclass 191 Visa is the Permanent Residency visa which is available after three years on a Subclass 491 – Skilled Regional Provisional Visa, or a Subclass 494 – Skilled Employer Sponsored Regional Visa. 

 

Introduction

If you have been granted either a Skilled Regional Provisional Visa (Subclass 491, with either State or Territory nomination, or nomination by an eligible relative);  OR a Subclass 494 – Skilled Employer Sponsored Regional Visa, you will know that these visas are for a validity period of 5 years, and during that time you must meet certain conditions.  The 491 and 494 visas are Provisional Visas, meaning they are part 1 of a two part visa, which ends with permanent residence. 

Once you have completed three years of residence on one of these visas, you may apply for Permanent Residency through an application for a Subclass 191 visa.   

What are the eligibility requirements?

  • Have held a Subclass 491 or 494 visa for at least 3 years; 
  • Substantially complied with all conditions listed on your current visa; with the exception of condition 8579 (“Must live, work and study only in a part of Australia that was a designated regional area at the time the visa was granted”);
  • Unless exempt, you must have fully complied with condition 8579;
  • Provide a copy of Income Tax Assessment Notices in relation to three relevant income years for the primary applicant;
  • Have been usually resident in Australia for a continuous period of 3 years before the date of application;
  • Family members who are holding a Subclass 491 or 494 visa as dependents on the primary applicant, may be applicants on the Subclass 191 application, regardless of their dependence on the primary applicant at the time of 191 application.  This allows adult children who are no longer “dependents”, to avoid being disadvantaged, and to obtain permanent residence with their parents.  It also permits couples who are separated, to apply on the same visa at time of permanent residence, if that is the desired outcome for the family
