EMPLOYER NOMINATION SCHEME

SUBCLASS 186 (TEMPORARY RESIDENCE TRANSITION)

If your Australian employer is willing to nominate you, and you’ve been working on a Subclass 457 or 482 (“TSS” or “SID”) visa for 2 years out of the last three, this visa gives you permanent residence in Australia.

Introduction

The Employer Nomination Scheme provides a permanent residence transition pathway for skilled sponsored workers.

The ‘Temporary Residence Transition’ stream requires applicants to hold a subclass 457, 482 (Skills in Demand or Temporary Skills Shortage) or Bridging Visa (A, B or C in association with another 482 visa).  Applicants must have held a qualifying visa for two years out of the last three; and their most recent employer sponsor must nominate them for the 186 visa.  Work undertaken with more than one employer sponsor will qualify, as long as the person was formally sponsored during that work period.

Applicants must be under 45 at the time of application, unless they are being paid a high salary, in excess of the Fair Work High Income Threshold.

What are the eligibility requirements?

  • People under 45 who have been working on a Subclass 457 or 482 visa for at least 2 years, and whose employer sponsor is prepared to continue to employ them for at least 2 years. 
  • The employer must have met all legal requirements as a Sponsor while the person was on the 457 or 482 visa. 
  • The applicant must have COMPETENT English (IELTS 6 in every band, or equivalent test score, unless exempt)

What will this visa provide?

  • Permanent residency of Australia
  • Medicare and certain Government benefits
  • Rights to work and study in Australia
  • Travel rights to and from Australia for five years
  • Opportunity to work towards Australian citizenship

Note: all costs marked in red must by law be met by the Employer &  cannot be passed on to the visa applicant. 

*The Nomination fee is not payable for positions in designated regional areas.

** The SAF levy is $3,000 if business turnover is less than $10 million per annum; otherwise $5,000.
